When Meal Period Waivers Are Allowed

Meal waivers are only permitted:

  • For shifts under 6 hours (first meal period can be waived).
  • For shifts over 10 hours, the second meal period may be waived if the first was taken.

What Employers Need to Know

Employees working an 8-hour shift must receive their legally required meal break. They cannot waive it simply because they choose not to take one.
